This User Agreement regulates the relationship between the Administration of the Photo Editor "Paradeo Photo Editor" (hereinafter referred to as the Photo Editor) and the Users, including determining the procedure and conditions for using the Photo Editor and its protected objects and is a public offer based on 437 of the Civil Code of the Russian Federation.
1.1. Photo editor - available to users at http://paradeo.ru and also as an application in the appstore and google play on the Internet, a set of the following protected results of intellectual activity:
a) computer programs that allow Users, with access to the global Internet, to create personal pages, search for information about other Users, get acquainted with their personal pages, exchange personal messages with other Users, independently post, copy and download photographs and other Content, as well as use other functions;
b) databases in the form of a collection of information and Content posted by the Administration of the Photo Editor and the Users, including when creating and filling in the personal pages of the Users;
c) computer programs (applications) placed in the Photo Editor by the administration or with the consent of the Administration by third parties, or their elements that can be used by the Users in addition to the main functions of the Photo Editor and intended for entertainment, training or other purposes;
d) other protected and non-protected results of intellectual activity.
1.2. Administration - Individual entrepreneur Ilyaev Leonid Lvovich (OGRNIP 312774610900398, TIN 772153436088) and persons authorized by him, ensuring the functioning of the Photo Editor and providing maintenance and administration of the Photo Editor.
1.3. User - a person who is a member of the Photo Editor, and who, on the basis of this User Agreement, is granted the right to use the Photo Editor functionality.
1.4. Content - works of science, literature and art placed in the Photo Editor, including photographs, graphics, design elements, texts, videos, sound recordings, and other objects that are the result of intellectual activity or not.
2.1. This User Agreement is a legally binding agreement between the User and the Administration of the Photo Editor, the subject of which is the provision by the Social Administration to the User of services for using the functionality of the Photo Editor and its services.
2.2. In addition to this User Agreement, the rules for the use of the Photo Editor by Users may be contained in special documents governing the provision of certain services of the Photo Editor. 2.3. The user is obliged to fully familiarize himself with this User Agreement before registering with the Photo Editor.
2.4. Registration of the User in the Photo Editor means full and unconditional acceptance by the User of this User Agreement in accordance with Art. 435 and Art. 438 of the Civil Code of the Russian Federation.
2.5. The actual use of the Photo Editor without registering in it in the form, in particular, viewing individual images or personal pages of other Users is also an acceptance of this User Agreement.
2.6. This User Agreement can be changed by the Administration of the Photo Editor unilaterally without any special notification to Users, but subject to posting a new edition of the User Agreement in the public domain to familiarize Users with the current User Agreement.
2.7. Continued use of the Photo Editor by the User after making changes to this User Agreement means acceptance and unconditional consent of the User with such changes.
3.1. Registration of the User in the Photo Editor is a voluntary act.
3.2. The user is responsible for the accuracy, relevance, completeness and compliance with the legislation of the Russian Federation of the information provided during registration.
3.3. The user guarantees that he has all the necessary powers to conclude this User Agreement. If the User has not reached the age of majority or has become completely incapacitated due to the occurrence of a circumstance stipulated by the current legislation, he is obliged to independently obtain the necessary permission in the form required by law from his parents or other legal representatives.
3.4. The username and password selected by the User or assigned by the system are necessary and sufficient information for the User to access the Photo Editor.
3.5. The user does not have the right to transfer his login and password to third parties and is fully responsible for their safety.
3.6. Any actions performed using the User's login and password are considered to have been committed by the relevant User, unless otherwise proven in the prescribed manner.
3.7. In case of compromise of the username and / or password or unauthorized access to the User's personal page or username and / or password, the User is obliged to immediately inform the Administration of the Photo Editor about it.
4.1. The user has the right to:
4.1.1. use for personal non-commercial purposes the content of your own personal page and the Content posted in the Photo Editor;
4.1.2. use the Photo Editor functionality and applications in good faith;
4.1.3. customize your personal page;
4.1.4. to carry out other actions not prohibited by the legislation of the Russian Federation or this User Agreement related to the use of the Photo Editor.
4.2. The user is obliged:
4.2.1. comply with the norms of the current legislation of the Russian Federation;
4.2.2. comply with the provisions of this User Agreement and other special documents of the Administration posted in the public domain;
4.2.3. when registering with the Photo Editor, provide reliable information;
4.2.4. use the functionality of the Photo Editor for personal purposes not related to the commercial activities of citizens and organizations;
4.2.5. follow the instructions of the Administration on using the Photo Editor functionality;
4.2.6. at the request of the Administration in connection with the execution of this User Agreement, provide the surname, name, patronymic and other data;
4.2.7. before posting any information and any objects in the Photo Editor (in particular, images of other persons, texts of someone else's authorship, visual and audiovisual works), preliminary assess the legality of their posting;
4.2.8. not to post on the personal page any information and any objects (including links to them) that may violate the rights of others;
4.2.9. do not post photos in which other persons are captured in addition to the User, without their prior consent, except in cases where, in accordance with article 152.1. Of the Civil Code of the Russian Federation, such consent is not required;
4.2.10. periodically get acquainted with the content of this User Agreement on the Internet and follow the changes made to it;
4.2.11. comply with other requirements and fulfill other obligations stipulated by this User Agreement and other special documents of the Administration posted in the public domain.
When using the functionality of the Photo Editor, the User is prohibited from:
5.1. upload, post, store, reproduce, process, distribute, publish in the Photo Editor, communicate to the public, or otherwise use, in whole or in part, any objects of intellectual property rights, without the prior written permission of the copyright holders, except as otherwise provided for by the current legislation of the Russian Federation;
5.2. carry out propaganda inciting social, racial, national or religious hatred and enmity, propaganda of war, social, racial, national, religious or linguistic superiority; 5.3. post in the Photo Editor in the public domain without the prior consent of the Administration, text messages, graphics and other materials that contain advertising;
5.4. carry out any actions aimed at destabilizing the functioning of the Photo Editor, attempt to unauthorized access to the control of the Photo Editor;
5.5. post in the Photo Editor messages, graphics and other materials that contain threats or the publication of which causes or may damage the honor, dignity and business reputation of a citizen or the business reputation of an organization;
5.6. to carry out unauthorized access to the accounts of other Users by collecting or entering a password, as well as to make any attempts for such access; upload, store, publish, distribute or otherwise use viruses and other malware;
5.7. use the Photo Editor for commercial purposes without the prior written permission of the Administration; 5.8. send spam in any form and in any way;
5.9. upload, post, store, reproduce, process, distribute, publish in the Photo Editor, communicate to the public, or otherwise use any information that: 5.9.1. is obscene, contains pornographic images and / or texts or scenes of a sexual nature involving minors;
5.9.2. contains scenes of inhuman treatment of animals;
5.9.3. contains a description of the means and methods of suicide, any incitement to commit it;
5.9.4. contains extremist materials, propagandizes fascism;
5.9.5. promotes criminal activity or contains advice on the commission of criminal acts; 5.9.6. contains advertisements or describes the attractiveness of drug use, information about the distribution of drugs, recipes for their manufacture and advice on drug use;
5.9.7. contains information of limited access, including state, commercial, family secrets;
5.9.8. is fraudulent;
5.9.9. violates other rights and interests of citizens and legal entities;
5.9.10. violates the requirements of the current legislation of the Russian Federation.
6.1. The processing of the User's personal data is carried out in accordance with the current legislation of the Russian Federation.
6.2. The Administration of the Photo Editor processes the User's personal data in order to fulfill the concluded agreement - this User Agreement for the provision of services to the User, the development of the Photo Editor, and also in order to receive personalized advertising by the User.
6.3. The Administration of the Photo Editor takes all necessary measures to protect the User's personal data.
6.4. The Administration of the Photo Editor has the right to disclose the User's personal data only in cases established by the legislation of the Russian Federation (including in order to prevent and / or suppress illegal actions of the User).
6.5. The Administration has the right to send the User information about the development of the Photo Editor, as well as advertise its own activities and services.
7.1. The Administration is not responsible for possible failures and interruptions in the work of the Photo Editor and the loss of User information caused by them.
7.2. Photo Editor, including all applications hosted in Photo Editor, is provided “as is”. The administration does not give any guarantees that the functionality of the Photo Editor may or may not be suitable for specific purposes of use. The administration cannot guarantee and does not promise any specific results from using the functionality of the Photo Editor and / or applications located in the Photo Editor.
7.3. The Administration is not responsible for any damage to the User's personal computer, mobile devices, other equipment or software associated with the use of the Photo Editor or sites accessible via hyperlinks posted in the Photo Editor.
7.4. The administration is not responsible for the selection of the password for access to the User's account by third parties and any actions performed by them using the User's account.
7.5. The administration is not responsible for any harm caused in connection with the use of the Photo Editor and the materials posted in it.
7.6. The administration is not responsible for the possible harm to the health of the User, which may be caused in connection with the use of the Photo Editor applications.
7.7. The user is solely responsible for illegal actions carried out using his account, as well as in connection with the posting of Content using his account in the Photo Editor.
7.8. The user is solely responsible for any Content or other information that he posts in the Photo Editor or otherwise communicates to the public with its help.
7.9. Hyperlinks to any website, product, service, any information posted in the Photo Editor are not an endorsement or recommendation of these products (services) by the Administration. The administration is not responsible for the harm caused to the User and / or his property as a result of clicking on such hyperlinks.
8.1. The placement of any protected object of intellectual property in the Photo Editor does not entail the termination of the legal protection of intellectual property.
8.2. No protected Content can be reproduced, processed, distributed, published, downloaded, transferred, or otherwise used in whole or in part without the prior written permission of the copyright holder, unless otherwise provided by the current legislation of the Russian Federation.
8.3. By posting Content in the Photo Editor, the exclusive right to which belongs to him, gratuitously grants other users the right to use the Content under the terms of a non-exclusive license in any way, but solely for the purpose of personal non-commercial use and unchanged.
8.4. The User, posting Content in the Photo Editor, the exclusive right to which belongs to him, grants the Administration the right to use the Content free of charge under the terms of a non-exclusive license in order to ensure the functioning of the Photo Editor by the Administration to the extent determined by the functionality of the Photo Editor.
8.5. The user does not have the right to post in the Photo Editor Content, the exclusive rights to which do not belong to him, without the prior written consent of the copyright holder.
8.6. The Content uploaded and posted by the User in the Photo Editor is not moderated and verified by the Administration.
8.7. The Administration takes actions to protect the rights and interests of individuals and ensure compliance with the requirements of the legislation of the Russian Federation only after the interested person has contacted the Administration in the prescribed manner.
8.8. The administration guarantees the prompt removal of illegally posted Content after the request of the copyright holder in the prescribed manner.
8.9. The Administration of the Photo Editor has the right, but is not obligated to view the Photo Editor for the presence of prohibited Content and has the right to delete without warning and any compensation any Content or User accounts at its discretion, for any reason or no reason, including the removal of Content, which, in its personal opinion Administration violates the provisions of this User Agreement, the legislation of the Russian Federation, or may violate the rights of others.
8.10. Nothing in this User Agreement gives the User the right to use the company name, trademarks, domain names and other means of individualization, the rights to which belong to the Administration. The right to use the company name, trademarks, domain names and other means of individualization, the rights to which belong to the Administration, can be granted only by written agreement with the Administration.
9.1. This User Agreement enters into force for the User from the moment determined by clauses 2.4 and 2.5 of this User Agreement, and is valid for an indefinite period.
9.2. This User Agreement is drawn up in Russian and, at the discretion of the Administration, may be provided to the User for further review in another language. In the event of a discrepancy between the provisions of the Russian-language version of the User Agreement and the version of the User Agreement in another language, the provisions of the Russian-language version of this User Agreement shall apply.
9.3. The invalidity of one or more provisions of this User Agreement, recognized in the prescribed manner by a court decision that has entered into force, does not entail the invalidity of this User Agreement as a whole.
9.4. If one or more provisions of this User Agreement are recognized as invalid in the prescribed manner, the parties to this User Agreement undertake to fulfill their obligations as close as possible to the parties implied when concluding this User Agreement in a manner.
9.5. All disputes between the parties under this User Agreement are subject to resolution through negotiations using the mandatory pre-trial (claim) procedure. If it is impossible to reach an agreement between the parties through negotiations within 90 (ninety) calendar days (taking into account the time of mail delivery of correspondence) from the moment the other party receives a written claim, the dispute should be referred by the interested party to the court at the location of the Administration.
9.6. This User Agreement is interpreted in accordance with the current legislation of the Russian Federation.
9.7. Issues not regulated by this User Agreement are subject to resolution in accordance with the current legislation of the Russian Federation.
